The Website provides you with an opportunity to browse and purchase various coaching programs, including The Power Hour and The Moxie Business Advantage (Services). You can also book a free Moxie Breakthrough Session (Breakthrough Session) and access free digital resources (Digital Resources). The Website provides these services by granting you access to the content and tools available (Purchase Services).
The Website is operated by The Moxie Movement Ltd, a business registered in New Zealand and trading as The Moxie Movement (The Moxie Movement). Access to and use of the Website, or any associated Services, are provided by The Moxie Movement. Please read these terms and conditions (Terms) carefully. By using, browsing, or accessing the Website, you signify that you have read, understood, and agree to be bound by the Terms. If you do not agree with the Terms, you must cease using the Website or any associated Services immediately.
The Moxie Movement reserves the right to review and change any of the Terms at its sole discretion by updating this page. Changes to the Terms take immediate effect from the date of publication, and your continued use of the Website constitutes your acceptance of such changes.
ACCEPTANCE OF THE TERMS
You accept these Terms by remaining on the Website or engaging with any of its Services.
BOOKINGS OF MOXIE BREAKTHROUGH SESSION
Bookings for the Breakthrough Session must be made via the designated booking system (Booking System). If you choose to create an account with the Booking System, you agree to the Terms and Conditions, Privacy Policy, and other legal documentation provided by the Booking System.
Should you wish to cancel or reschedule your free appointment, please notify dolly@mail.themoxiemovement.com at least 48 hours prior to your scheduled appointment to allow your time slot to be allocated to another individual.
PURCHASE OF SERVICES
By purchasing a Service through the Website, you agree to pay the listed price for that Service (Purchase Price).
Payments can be made through the payment methods provided (Payment Gateway Providers). Unless otherwise stated, all amounts are listed in US Dollars (USD) and are GST inclusive, being goods and services tax as defined in Goods and Services Tax Act 1985, inclusive amounts. Where the services are provided outside New Zealand, GST is inapplicable
By using the Purchase Services, you agree to the terms and conditions, privacy policies, and any other relevant documentation of the Payment Gateway Providers.
Once payment is confirmed, you will receive a receipt, and The Moxie Movement may record your purchase details for future reference.
If payment is not made in full on the due date, The Moxie Movement reserves the right to charge interest at 5% per annum, calculated daily. Costs incurred for enforcing payment terms will also be recoverable from you.
The Moxie Movement reserves the right to adjust pricing for future purchases of Services at any time.
DELIVERY OF SERVICES AND LICENSE INFORMATION
Purchasing a Service grants you access to the relevant program through the designated online platform. For instance:
The Power Hour and The Moxie Business Advantage programs may include access to educational content, templates, and other resources via a secure portal.
Your purchase grants you a limited, non-exclusive, non-transferable license to use the materials provided for personal, non-commercial purposes only (License).
Sharing access or content, including templates and resources, with third parties is strictly prohibited.
PROGRAM TERMINATION AND REFUNDS
Programs are non-refundable. If you terminate a program early, any remaining balances owed must be paid within seven days.
The Moxie Movement reserves the right to terminate your participation in the Services for breach of these Terms with seven days’ notice via email. If terminated, you will only be charged for Services provided up to the termination date.
Refunds will only be provided if The Moxie Movement is unable to deliver the Services.
MEMBER CONDUCT AND OBLIGATIONS
As a participant in any of The Moxie Movement's Services, you agree to:
Use the Services only for lawful purposes.
Keep your account login credentials confidential.
Immediately notify The Moxie Movement of unauthorized use of your account.
Refrain from harassing, defaming, or infringing on the intellectual property of others.
The Moxie Movement reserves the right to revoke your access to Services for violating these terms.
PAUSING, CANCELLATION, AND TERMINATION OF MEMBERSHIPS
THE POWER HOUR PROGRAM
You may request to pause or cancel your The Power Hour membership by contacting sarah@mail.themoxiemovement.com. Membership fees are non-refundable and a cancellation requires a 30 day written notice to this email. Your payments will continue for 30 days as will you access after this email.
The Moxie Movement understands that unexpected life events occur. Membership pauses may be granted at the company’s discretion, subject to an administrative fee and adjusted program timelines.
THE MOXIE BUSINESS ADVANTAGE PROGRAM
30-DAY ‘LOVE IT OR LEAVE IT’ PERIOD – THE MOXIE BUSINESS ADVANTAGE
The Moxie Movement wants you to be fully satisfied with your purchase and offers a 30-day ‘Love It or Leave It’ Period for The Moxie Business Advantage program, governed by the following terms:
To cancel your membership under this policy, you must contact sarah@mail.themoxiemovement.com within the first 30 days of your initial Call to notify The Moxie Movement of your decision to cancel (Love It or Leave It Period).
After the Love It or Leave It Period, you are responsible for the full payment of the Membership Fees, regardless of whether you complete the program.
Upon cancellation under this policy, The Moxie Movement will promptly terminate your access and licenses for all materials provided under The Moxie Business Advantage. You agree to cease using any materials supplied, including but not limited to downloaded video recordings, audio files, forms, templates, or any other program-related content. You must immediately delete these materials from all devices and storage systems.
PAUSING, CANCELLATION, AND TERMINATION OF YOUR MEMBERSHIP
Cancellation and Termination
You may cancel your membership by providing written notice to sarah@mail.themoxiemovement.com
With the exception of the 30-day ‘Love It or Leave It’ Period, Membership Fees are non-refundable.
If you choose to terminate your membership early, all unpaid amounts of the Membership Fees remain non-refundable and must be paid in full.
If you have selected a payment plan and terminate early, The Moxie Movement reserves the right to immediately collect all outstanding amounts of the Membership Fees without notice by charging your designated payment method. Your access to the Services will be revoked.
If you are unable to attend any group coaching session, you will not be eligible for a refund for the missed session.
The Moxie Movement reserves the right to amend the Termination Policy at any time, with prior registrations remaining unaffected by the changes.
The Moxie Movement reserves the right to terminate your membership and involvement in the Services for breach of these Terms and Conditions with seven days’ notice via email.
In the event of termination by The Moxie Movement, you agree to pay for all Services provided up until the termination date.
After completing the 12-month Membership Period, you may cancel your membership by providing 30 days’ written notice to sarah@mail.themoxiemovement.com. Payments will cease to be deducted from your original payment method 30 days after receipt of your cancellation notice.
Pausing of Membership
The Moxie Movement requests that you make every effort to ensure your participation in The Moxie Business Advantage is not interrupted by external events. However, we understand that unexpected life circumstances such as illness or personal matters may arise.
At its sole discretion, The Moxie Movement may allow you to pause your membership for up to one month (Membership Pause).
To request a Membership Pause, email sarah@mail.themoxiemovement.com with a detailed explanation of the circumstances requiring the pause.
If your request is approved, an administrative fee (outlined in writing) will be applied, and you will be notified of your adjusted program completion date and any other relevant changes.
The Moxie Movement is not responsible for any loss or inability to continue the program once the Services resume following a Membership Pause.
WARRANTY
The Moxie Movement will make every effort and take all reasonable steps to help you achieve your desired results. However, we do not guarantee that the Services will meet your specific requirements or that all participants will achieve the same outcomes.
In compliance with New Zealand consumer law, the Services come with guarantees that cannot be excluded. For major failures in the Services, you are entitled to cancel your agreement with The Moxie Movement and receive a refund for the unused portion or compensation for its reduced value. A major failure includes, but is not limited to, circumstances where the Services are unfit for their intended purpose or unsafe for use.
SERVICES DISCLAIMER
You are solely responsible for creating and implementing your own career or business strategies, mental and emotional well-being, decisions, choices, actions, and results arising from or related to the Services and your sessions and interactions with The Moxie Movement. As such, you agree that The Moxie Movement is not and will not be liable or responsible for any actions or inactions, including their impact on your personal life or career, or for any direct or indirect outcomes resulting from the Services provided by The Moxie Movement.
To enhance the value of your relationship and sessions with The Moxie Movement, you agree to communicate openly and honestly, remain receptive to feedback and assistance, and dedicate the time and energy needed to fully participate in the Services.
COPYRIGHT AND INTELLECTUAL PROPERTY
All content on the Website and in the Services, including text, graphics, logos, and materials, is owned by The Moxie Movement or licensed for its use. You may not reproduce, distribute, or share this content without prior written permission.
PRIVACY
The Moxie Movement values your privacy. Information collected via the Website and Services is managed in accordance with the company’s Privacy Policy.
